These Terms of Service (the “Terms”) govern your access to and use of the Site and your purchase of products from Floatelier Store (“Floatelier”, “we”, “us”, or “our”). The Site offers magnetic-levitation décor, lighting, accessories, and related products (collectively, the “Products”).
By visiting the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Site or place an order.
Before publishing: Confirm the website address, legal business address, governing-law jurisdiction, and the payment, fulfilment, shipping, and tax settings shown at checkout. These Terms do not replace mandatory consumer rights that apply where you live.
1. Eligibility and acceptable use
You must be legally capable of entering into a binding contract in your jurisdiction to place an order. If you use the Site or place an order on behalf of a company or other organisation, you confirm that you have authority to bind that organisation to these Terms.
You agree to use the Site only for lawful purposes and in accordance with these Terms. You must not:
- use the Site to commit or facilitate fraud, unlawful activity, or infringement of another person’s rights;
- interfere with, disrupt, damage, or attempt to gain unauthorised access to the Site, its systems, accounts, or data;
- introduce viruses, malware, or other harmful code;
- scrape, copy, reproduce, distribute, or exploit Site content except as permitted by law or with our written permission; or
- make false, misleading, or abusive claims in relation to an order, return, payment, or warranty request.
2. Product information and availability
We aim to describe and display Products accurately. However, photographs, videos, colours, dimensions, materials, packaging, and other product details may appear differently depending on your device, display settings, product batch, or ordinary manufacturing variation.
Magnetic-levitation Products use precision magnetic and electronic components. Please read and follow all product instructions, safety information, power requirements, and care guidance supplied with the Product. Do not disassemble, modify, repair, or recalibrate a Product unless Floatelier has provided written instructions.
Products are subject to availability. We may change, discontinue, limit, or update Products, features, packaging, promotions, or prices at any time before an order is accepted, subject to applicable law. We do not guarantee that every Product will always be available in every country or region.
Nothing on the Site is intended as a guarantee that a Product will be suitable for a particular purpose unless we expressly confirm this in writing.
3. Orders and contract formation
Submitting an order is an offer to purchase the Products shown in your order. An order-confirmation email acknowledges that we received your order; it does not by itself mean that we have accepted it.
We accept an order when we dispatch the Products or otherwise expressly confirm acceptance. We may decline, cancel, or limit an order before acceptance where permitted by law, including where:
- a Product is unavailable;
- the price, product description, promotion, stock status, or other information contains an error;
- payment cannot be authorised or completed;
- we reasonably suspect fraud, abuse, unauthorised resale, or unlawful activity; or
- delivery cannot be completed to the supplied address.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item(s) using the original payment method, subject to applicable law.
4. Prices, payments, and taxes
Prices, available currencies, delivery options, shipping charges, discounts, and applicable taxes shown at checkout apply to your order. The total payable amount will be displayed before you complete checkout.
We may correct obvious pricing, product-information, or promotional errors. If an error affects an order after it is placed, we may contact you with the corrected information and give you the option to proceed or cancel. If we cannot reasonably contact you, or if the correction is not accepted, we may cancel the affected order and issue an appropriate refund.
Payments are processed through the payment methods made available at checkout. You represent that you are authorised to use the selected payment method and that the payment details you provide are accurate and complete.
For cross-border orders, import duties, VAT/GST, customs fees, brokerage charges, and other destination-country charges may apply. Unless expressly included at checkout, these amounts are the customer’s responsibility. See our Shipping Policy for further information.
5. Shipping, delivery, and risk of loss
Shipping availability, estimated delivery timing, and shipping costs are described at checkout and in our Shipping Policy. Processing and transit times are estimates only and are not guaranteed delivery dates, except where applicable law provides otherwise.
You are responsible for providing a complete and accurate delivery address, telephone number, and email address. Contact us immediately at floatelierstore@outlook.com if you need to request an address correction, order change, or cancellation. We cannot guarantee changes once an order has been processed, packed, or dispatched.
For consumer purchases, risk of loss or damage transfers as required by applicable law. Nothing in these Terms is intended to reduce consumer protections that cannot legally be excluded. For additional delivery, customs, damaged-parcel, and delivery-issue terms, please read our Shipping Policy.
6. Returns, refunds, exchanges, and warranty support
Our voluntary return window, return conditions, refund process, exchange process, and limited warranty are described in our Return, Refund & Limited Warranty Policy.
If a Product arrives damaged, incorrect, incomplete, or appears defective, contact us before returning or attempting any repair. Include your order number and, where possible, clear photographs or video of the Product, packaging, shipping label, and issue.
Nothing in these Terms or our policies limits statutory cancellation, withdrawal, conformity, repair, replacement, refund, or other consumer rights that apply to you. In particular, eligible EU/EEA and UK consumers may have statutory cancellation/withdrawal rights and legal guarantees in addition to our voluntary policies.
7. Accounts and electronic communications
If the Site allows you to create an account, you are responsible for safeguarding your login credentials and for activity that occurs through your account. Notify us promptly if you believe your account has been accessed without authorisation.
By using the Site or placing an order, you agree that we may communicate with you electronically about your order, account, Products, policies, and customer-support requests. Transactional messages, including order and shipping updates, are not marketing communications.
Marketing communications are sent only as permitted by applicable law. You may opt out of promotional emails by using the unsubscribe link in the email or by contacting us. Opting out will not stop essential transactional or service messages.
8. Intellectual property
The Site and its contents, including text, product copy, photographs, graphics, logos, videos, designs, trademarks, software, and layout, are owned by Floatelier, our licensors, or other rights holders and are protected by applicable intellectual-property laws.
Except for the limited right to use the Site for personal, non-commercial shopping, no content may be copied, reproduced, modified, distributed, displayed, transmitted, or used without the relevant rights holder’s prior written permission.
“Floatelier” and related names, logos, and marks may not be used without our prior written consent.
9. Reviews, feedback, and user content
If you submit a review, comment, image, video, suggestion, or other content to us or through the Site (“User Content”), you confirm that you have the necessary rights to submit it and that it does not violate law or another person’s rights.
To the extent permitted by law, you grant Floatelier a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to use, reproduce, modify for formatting, publish, display, distribute, and otherwise use User Content for operating, promoting, and improving our business and Products. This licence ends when the User Content is deleted from our systems, except where we need to retain it for legal, archival, or operational purposes, or where it has been incorporated into aggregated or de-identified materials.
We may remove or decline to publish User Content where we reasonably believe it violates these Terms, infringes rights, is misleading, or is otherwise inappropriate.
10. Third-party services and links
The Site may include links to, integrations with, or content from third-party websites, payment providers, social-media platforms, carriers, or other services. Those third parties are responsible for their own content, products, policies, and privacy practices. A link does not mean that Floatelier endorses or controls the third party.
Your use of third-party services is governed by their own terms and policies. Please review them before providing information or completing a transaction with a third party.
11. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you use the Site or interact with us. By using the Site, you acknowledge that your personal information will be processed as described in that policy.
12. Disclaimers and limitation of liability
To the fullest extent permitted by applicable law, the Site and its content are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, error-free, secure, or virus-free operation of the Site, or that all content will always be complete, current, or error-free.
To the fullest extent permitted by law, Floatelier will not be liable for indirect, incidental, special, punitive, or consequential loss or damage, including lost profits, lost data, loss of goodwill, or business interruption, arising out of or related to the Site, Products, or these Terms.
Where liability cannot be excluded but may be limited, Floatelier’s aggregate liability arising out of or relating to an order or these Terms will not exceed the amount you paid to Floatelier for the Product or service giving rise to the claim, unless applicable law requires a different remedy.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence where such liability cannot be excluded, or any other liability or consumer right that cannot lawfully be excluded or limited.
13. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold Floatelier, its owners, employees, contractors, and service providers harmless from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your unlawful use of the Site, your breach of these Terms, or your infringement of another person’s rights.
14. Governing law and disputes
These Terms and any dispute relating to them are governed by the laws of USA, without regard to conflict-of-law principles, except where mandatory law in your country of residence gives you greater protection.
Before starting formal proceedings, please contact us at floatelierstore@outlook.com and provide a clear description of the issue. We will try to resolve the matter in good faith.
Any courts with mandatory jurisdiction under applicable consumer law remain available to eligible consumers. This section does not remove rights that cannot legally be waived.
15. Changes to these Terms
We may update these Terms from time to time for operational, legal, regulatory, security, or business reasons. The updated Terms will be posted on the Site with a revised effective date. Changes apply prospectively unless law requires otherwise.
Your continued use of the Site after the updated Terms take effect constitutes acceptance of the revised Terms, except where applicable law requires another form of notice or consent.
16. Severability and no waiver
If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will continue in effect.
Our failure to enforce a provision of these Terms is not a waiver of that provision or any other right.
